:
Abstract Given the history of property rights and the development that has taken place over the centuries and the extent to which the Islamic Shariah has taken care of this right and our study on the restrictions on foreign ownership of the property in the Saudi system compared with the law of the Emirate of Dubai concerning the property ownership of Foreigners. The aim of this study is to improve the Saudi law regarding Foreigners ownership of real states to achieve the goals of the Saudi vision and for being in line with the latest rules. The issue of the study is understanding the extent of the contribution of property laws in attracting foreign investments as a result of allowing companies and individuals to own property in the Kingdom, but these regulations should not offer unlimited benefits and hence these shows the restrictions that must regulate the ownership of foreigners, thus shows the need to identify the limits of foreign ownership of the property by knowing what they are allowed to own of the property and what is not allowed in both the Saudi system and the laws of the Emirate of Dubai, and what are the criteria of these limits, which i have implemented in this study the use of the analytical methodology and horizontal comparison methodology. I have studied in the first chapter what relates to restrictions on owning property for citizens of the GCC countries in both legal systems. The second chapter deals with the restrictions on foreigners of other countries in owning property in both legal systems, showing similarities and differences between them. I have reached to a few conclutions, the most important are as follows: 1-The foreigners ownership law in the Emirate of Dubai has expanded ownership in comparison with the Saudi Arabian system, where foreigners have limited access to property by making it limited in obtaining permission from the competent authority. 2-It has not been identified in the non-Saudis property ownership and inve
