Abstract
:
The Study deals with the issue of compensation for the loss of opportunity with respect to its content, nature and conditions, as well as its regulatory rulings. it also shows the rules of compensation for the loss of utility according to Islamic jurisprudence (Fiqh), and the criteria for distinguishing, with illustrating the comparative role of the Saudi Judiciary in this respect, in addition to demonstrating the difficulty of assessing the lost opportunity per se as a financial value, from a practical aspect, when issuing judgments for compensation. The study found that the absence of a Saudi comprehensive civil law that regulates all rules of transaction was reflected on judiciary ruling on compensation claims for loss of opportunity, which are varied between pro et contra. There is a profound need for a civil transaction law that involves a special chapter for the compensation judgements. Such a law should include indemnity for the loss opportunity and reconsideration of the mechanism of compensation assessment. The law should consider the size of actual damages that are inflicted upon the injured party. In addition, there is a need to expand the discussions and the seminars to control the indemnity for damages of loss of opportunity. The study concludes that such a law has become an inevitable necessity.
